1. Who we are

These terms apply to services supplied by YAVUZ DIGITAL LTD, trading as Yavuz Digital, registered in England and Wales under company number 17536067. Our registered office is 71–75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom. Contact: info@yavuzdigital.com.

2. Our services

We offer website hosting and maintenance, authorised website security and configuration work, and web development. The website describes possible services; your accepted written proposal specifies the actual work, exclusions, deliverables, dependencies, fees and timing.

Security work is limited to systems you own or have authority to manage. No test, scan or configuration change is authorised simply by sending an enquiry.

3. Enquiries, proposals and orders

An enquiry is not an order and creates no payment obligation. Before you commit, we provide a proposal or order confirmation identifying the services, price, currency, applicable taxes, payment schedule and expected delivery. A contract begins when we confirm in writing that your acceptance has been received and the order is accepted. Agreed project-specific terms form part of the contract; they cannot remove mandatory legal rights.

Please check all details before acceptance. Changes to scope, fees or delivery dates must be agreed in writing. No new recurring charge is created by using this website.

4. Fees and payment

Prices are provided by written quotation. All amounts, the currency, tax treatment and separately authorised third-party costs will be disclosed before acceptance. Deposits, milestones or recurring fees apply only if specified in your proposal. Third-party costs require your approval.

Payment instructions and the available payment method are confirmed on the invoice or order confirmation. This website does not collect, process or store card numbers. Do not email payment card details. We do not represent that any particular payment provider is connected until it is separately confirmed for your order.

5. Delivery and your responsibilities

Services are delivered digitally. Expected dates and acceptance criteria are set out in your proposal. You must provide timely access, accurate instructions and materials you are entitled to use. You remain responsible for the legality of your content, your data and your business operations.

Access must be provided through a secure, agreed method using the minimum permissions needed. Do not send passwords through the enquiry form or ordinary email. Before significant work, we agree responsibility for backups and recovery. Any ongoing backup frequency, retention period or recovery commitment must be stated in your service agreement.

Delays caused by missing access or materials may require revised dates. We will discuss material changes and available options with you. See our Digital Delivery Policy.

6. Hosting, maintenance and recurring services

Any recurring service agreement must state what is included, the service period, billing frequency, renewal arrangements, support hours, cancellation process and any minimum term. We do not promise 24-hour support, uninterrupted availability, a response time or a service-level credit unless your agreement expressly includes it.

We give notice of a proposed recurring price change before it takes effect and explain the option to cancel before renewal. We do not apply an increased recurring price without the notice or consent required by your agreement and applicable law.

7. Cancellation, refunds and service problems

The Cancellation & Refund Policy explains how to cancel and how payments are assessed. If work does not meet the agreed scope, contact us promptly with the details so we can investigate and discuss correction or another appropriate remedy. Nothing in these terms limits a remedy required by law.

8. Intellectual property

You retain ownership of materials you supply. Ownership or licensing of deliverables, source files and pre-existing tools is set out in the proposal. Unless agreed otherwise, rights in bespoke deliverables transfer after the applicable fees are paid. Third-party software, fonts, assets and open-source components remain subject to their own licences. We will identify material third-party licensing requirements in the scope or handover.

9. Acceptable use and suspension

You must follow our Acceptable Use Policy. Where necessary to address illegal activity, a material security risk or a serious contractual breach, we may restrict the affected service. Where it is lawful and practical, we explain the reason, allow an opportunity to resolve the issue and discuss retrieval of your data. We will not use suspension to remove your statutory rights.

10. Security and limits

We take reasonable care in delivering the agreed services. Reviews identify issues within an agreed scope at a particular time; no website or security service can be guaranteed free from every threat, vulnerability or interruption. Findings are not certification, regulatory approval or a guarantee of future security.

For business customers, we are not responsible for losses caused by matters outside our reasonable control or losses that were not reasonably foreseeable when the agreement was made. Any specific liability cap must be separately set out in the accepted agreement. We do not exclude liability for fraud, death or personal injury caused by negligence, or any liability that cannot lawfully be excluded. Consumer statutory rights remain unaffected.

11. Privacy and confidential information

Our Privacy Policy explains how we handle personal data. If we process personal data on your behalf as part of a service, we will agree the required data-processing terms before that processing begins. Each party must protect the other’s confidential information and use it only to perform the agreement, except where disclosure is required by law.

12. Complaints and governing law

Send complaints to info@yavuzdigital.com with your project or invoice reference and the outcome you seek. We will review the details and respond through the agreed contact channel. Contacting us does not prevent you from exercising any available legal right.

These terms are governed by the laws of England and Wales. The courts of England and Wales have jurisdiction, subject to any mandatory rights you have as a consumer to the law and courts of your place of residence. We may update these website terms for future use; an existing contract changes only through the procedure agreed for that contract.
